Abstract

This paper summarizes the principal ethical aspects related to transplants: the peculiar dignity of the human being, the commercialization of the body, the informed consent, the death certification and the assignation of the organs with justice. Furthermore, it presents the recent controversies regarding the protocols for Non-Heart-Beating-Donors (NHBD), and studies the ethical implications of these procedures, that nowadays seem to be one of the best ways for increasing the number of transplants. The principal ethical issues which these protocols state are: the diagnosis the patient’s death, the interest and conflicts before the withdrawal, the attention the patient and his/ her family in respect to the organ preservation and his/ her previous consent; finally, the convenience establishing a national policy NHBD. In conclusion, the development the transplant medicine has stimulated the bioethical analysis and we notice with satisfaction that the NHBD protocols do not have a problem in sacrificing some technical efficiency, in order to increase the requirements of respect of the donor dignity.
