Merciful defense of lie
Abstract
In virtue of the ideological pluralism demanded by the preservation of the personal autonomy and liberty which are proclaimed by the 1991 Constitution, the Supreme Court has issued Statement No. C-239, 1997, which revokes the criminal character in mercy killing whit victim´s authorization in terminal illnesses.
The purpose of this paper is to show that such a statement does not respect the juridical pluralism since it violates the most fundamental human right and seems to be under a risk of not being constitutional when accepting that the Colombian juridical tradition has supported itself upon the Gospel. It also draws attention on the risk that such a doctrine represent because the regulations given by the most elevated state organisms posses an inevitable unprecedented value since citizen tends to focus them as truly behaving norms.Downloads
